Prize Draw General Terms & Conditions

 

Following are general terms and conditions relative to all Weldclass prize draw promotions, and are in addition to any terms and conditions outlined on the information page.

By registering for / participating in the promotion, you agree to these Terms and Conditions, which will at the time of your registration, become binding between you and us. This includes agreeing to receive periodic news/promotionional publications from Weldclass, from which you may opt out at any time by selecting the unsubscribe options provided.

No salesperson, representative or agent is authorised by us to give any guarantee, warranty or representation in addition to, or contrary to these Terms and Conditions.

 

Terminology

  • The 'Information page' refers to the any page on this website that contains specific details, and typically includes entry forms, relative to any Weldclass prize draw promotion.
  • 'The promotion' refers to the prize draw offer outlined on the information page.
  • The term 'giveaway' may also be used in the title given to any prize draw promotion by Weldclass
  • 'The Promoter' is JWL Marketing Pty Ltd (trading as “Weldclass”) of 5 Hawker Road, Taminda NSW 2340
  • 'Promotion period' refers to the period between the start or launch date, and the final end date of the promotion.
  • 'Cycle period' is applicable to promotions where a prize draw is repeated during the promotion period, and refers to the applicable daily or weekly or monthly repeated interval period as outlined on the information page

Entries & Entrants

Entry is only available via the means outlined on the information page.

The promotion is only open to eligible entrants. An “eligible entrant” is a person who:

  • Is an Australian citizen or a resident, and is currently residing in Australia
  • Submits an entry for the promotion in accordance with these Terms and Conditions
  • Registers this entry for themselves exclusively and not on behalf of any other person or group of person
  • Does not in any way tamper with the entry and/or the entry process
  • Complies with any other conditions outlined on the information page

Only one entry is permitted per promotional period or cycle period or per qualifying event (such as a purchase), as outlined on the information page). 

 

Purchases

If the promotion is related to purchases of Weldclass products, the following shall apply:

  • This promotion does not apply to any non-listed Weldclass products purchased during the promotion period or products purchased outside of the promotion period.
  • The promotion does not apply to Weldclass products that are purchased from: Non-Authorised Weldclass retailers including but not limited to sellers on eBay or Amazon sellers unless these are clearly marked as belonging to, and the purchase invoiced is issued from, a Weldclass authorised retailer. 

 

 

 

Prize Draws

Prize draws will take place typically within 10 business days from the end of the promotion period, or cycle period. Draw winners are advised by email or phone. 

 

General

No responsibility will be accepted for late, lost or misdirected entries.

The Promoter may require entrants to provide further information regarding the circumstances of the product purchases to the Promoter or its agent as part of the entry verification process. Failure to provide this information to the Promoter’s satisfaction may result in an invalid entry at the Promoter’s discretion.

Entries may only be submitted online and in the correct form provided for at the website and will not be accepted by the Promoter in any other form.

Any misrepresentation or fraudulent information supplied by a claimant disqualifies their claim(s) and registration.

The prize cannot be returned and is not, transferable or exchangeable and cannot be taken as cash.

The Promoter reserves the right, at any time, to verify the validity of entries and eligible claimants (including an eligible claimant’s identity and place of residence) and to disqualify any eligible claimant who submits a registration that is not in accordance with these Terms and Conditions or who tampers with the registration process. Suitable forms of verification are at the discretion of the Promoter. Errors and omissions may be accepted at the Promoter’s discretion.

The Promoter reserves the right to change, suspend or cancel the promotional offer at any time without notice.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including as a result of electronic tampering or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant or voter, or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.

The Promoter is not responsible for any technical malfunctions or problems with internet or network congestion, including injury or damage to a participant’s or any other person’s computer related to participation in this Promotion and problems with transmission of entries and / or emails over the internet, acts in violation of these terms and conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.

Any taxes which may be payable as a consequence of a Participant receiving a prize are the sole responsibility of the eligible claimant or participant.

The Promoter’s decision is final and no correspondence will be entered into.

Personal Information

The Promoter collects personal information in order to administer the promotion, the product warranty, for its own marketing purposes and for market analysis. The Promoter may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service partners and providers, offer suppliers. The Promoter will not otherwise disclose your personal information unless you have been informed or you have consented or when the Promoter are otherwise permitted or authorised to do so by law. Participation in the program is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. Claimants should direct any request to access, update or correct information to the Promoter. The Promoter’s privacy policy contains information about how you can access or correct personal information held about you or make a complaint about a privacy breach of the Australian Privacy Principles.

Liability

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties that are incapable of being excluded (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Governing Laws

The laws of NSW, Australia apply to this redemption to the exclusion of any other law. Claimants submit to the exclusive jurisdiction of the courts of NSW, Australia.
